Terms & Conditions
Definitions
General
These terms and conditions apply to all contracts entered into by the company unless otherwise stated in the company's written quotation. Any offer of equipment is subject to stock being available at the time of booking.
Hire charges do not include attendance by our employees for any purpose other than delivering, installing, dismantling and collecting equipment. If the hirer or one of their representatives or suppliers asks the company to attend site outside usual working hours to correct a fault, an additional charge may apply if the fault is due to factors outside the company’s control. This includes generators or heaters running out of fuel and third party suppliers tampering with electrical equipment.
The hirer is liable for any additional costs or charges incurred by the company in the event that extra work or equipment outside the terms of the quotation is required, or the equipment is required or used for any period outside the period of hire.
Generators are supplied with 24hrs (120 litres) of diesel. It is unlikely this will be sufficient to run lighting and refrigeration equipment such as chiller trailers overnight. Heaters are supplied with 12hrs (40 litres) of diesel. The hirer is permitted to supply additional diesel at their expense or the company can supply for £1+VAT per litre.
The company shall not be liable for delay or failure to complete any contracts as a result of: the site being unsuitable or access being restricted or unavailable on the planned installation day(s), adverse wind or weather conditions, grass sites which have not been cut or any other cause beyond its control.
In no circumstances will the liability of the company exceed the total hire charge
Payment Terms
At the time of booking the hirer will pay a deposit of 25% of the total hire fee inclusive of VAT (as detailed in the confirmation letter at the time of the order). This deposit is non-refundable once 12 months before the period of hire has passed. If the deposit is not received within 4 weeks of the confirmation letter being issued the company reserves the right to cancel the booking without notice. An interim payment of 25% is payable 6 months prior to the period of hire. The balance is payable one week prior to the commencement of the period of hire.
Cancellation
In the event of cancellation the following charges will be invoiced and due for payment on the date of commencement of the originally contracted period of hire:
Site Conditions
The company’s quotation is dependent on a level and firm site being provided with appropriate access for commercial vehicles. Vehicles must be able to unload and park within 20m of the site or additional charges may apply.
The company cannot be held responsible for damage to concealed or buried pipes, cables and other services and features unless their positions have been clearly marked by the hirer. Ground scanning equipment is available for an additional charge.
The quotation for lighting and power distribution equipment is made on the assumption that a suitable and sufficient power point is available within 30 metres of the marquee.
The company reserves the right to erect, deliver, dismantle and remove the equipment from the site at its convenience.
The hire charges do not include any repairs or making good that may be required to the site prior to installation, or any clearing of the marquee that may be required following the event e.g. empty glasses, decorations, waste and all other items or equipment that does not belong to the company.
Health and Safety
The company reserves the right, in its absolute discretion, to require the evacuation of a marquee(s) and/or the cancellation of an event to be held in the marquee(s). Where this occurs due to health and safety considerations the company accepts no liability for any loss whatsoever.
Hirer's Responsibilities
The hirer shall provide the company with a plan showing where he/she requires the equipment to be erected, or have a representative on site for that purpose. Otherwise the company will erect the equipment where it thinks best. Further charges may apply if positioning the equipment is delayed by more than 30 minutes due to reasons within the hirer’s control or if the hirer wishes equipment to be repositioned.
The hirer is responsible for obtaining any site permits that may be necessary including parking.
The hirer is responsible and will indemnify the company against any loss or damage whatsoever the cause unless a ‘Damage Waiver Fee’ has been paid. In the event of a claim for loss or damage being accepted by the company's insurers, the hirer will be liable for the first £500.00 of any such loss or damage. The hirer remains responsible and will indemnify the company against any loss or damage to all equipment resulting from wanton damage or negligence.
Marquees or electrical equipment installed by the company must not be moved or altered after installation without the company’s written agreement.
The hirer will not permit smoking or allow any fixings, crepe paper, straw bales, stickers, inflammable materials or heating appliances to be used in any marquee without the company’s written agreement.
The hirer must clear the site of all obstacles e.g. garden furniture prior to the delivery of the marquee. If the company has to move any obstacles it will not be held responsible for any damage that occurs as a result and additional charges may apply.
As temporary constructions, marquees cannot provide full protection against all weather conditions. In the event of snow the hirer must heat the interior to not less than 12 degrees centigrade in order to allow the snow to melt. In the event of windy conditions the hirer must ensure that all openings are firmly closed when not in use and perform daily checks on the condition of stakes/pegs in the ground to ensure they are secure.
If the equipment supplied includes a luxury toilet trailer the hirer must notify the company in writing if they plan to use the trailer for more than one day e.g. a second event or guests camping. The hirer must detail the number of guests and duration for each additional day or event and additional charges may apply.
The hirer shall ensure that all doors and other openings into the marquee(s) are closed and secured at all times during which the marquee(s) are not in use.
The hirer is responsible for the safety of their own goods whilst in the company’s marquees.
Third Party Liability
The company will not be responsible for, and the hirer will indemnify the company against, all claims for injury to persons, or loss of, or damage to, property, however caused, unless it can be proved that such injury or damage resulted from faulty materials, workmanship or negligence on the part of the company. The company will not be responsible for mechanical or electronic failure irrespective of the cause.
Force Majeure
Whilst every effort will be made by the company to complete any orders, the company cannot be held liable for variation or non-completion of orders due to acts of god: fire, flood, storm, gale, tempest, war, pandemic, terrorism, strikes, riots, lockouts or any other civil disturbances.
- "The company" is OAKLEAF MARQUEES LIMITED including its appointed agents and contractors.
- "The hirer" is the person or organisation hiring equipment from the company.
- "The equipment" is all items provided to or hired by the hirer.
- "The period of hire" means the time commencing with the arrival of the equipment on site and terminating when the equipment is removed by the company.
- "The hire agreement" is the contract entered into by the hirer and the company.
